1. OVERVIEW
This website is operated by Nestchill. Throughout these Terms of Service (the “Terms”), the terms “Nestchill,” “we,” “us,” and “our” refer to Nestchill.
Nestchill offers this website, https://nestchill.com (the “Website”), including all information, features, products, and services made available through the Website, to you conditioned upon your acceptance of these Terms and all other policies referenced on the Website.
By accessing the Website, creating an account, submitting customization materials, or placing an order, you agree to be bound by these Terms. If you do not agree, you must not access the Website or use our services.
2. ELIGIBILITY AND ONLINE STORE TERMS
You must be at least the age of majority in your state of residence to place an order or create an account. If you permit a minor dependent to use the Website, you are responsible for that use.
You may not use the Website or our products for any unlawful or unauthorized purpose, violate any applicable law, transmit malicious code, interfere with the Website’s operation, or attempt to gain unauthorized access to any system or account.
We may refuse or discontinue service where reasonably necessary, including in cases of suspected fraud, abuse, unlawful activity, violation of these Terms, or inability to fulfill an order.
3. ACCOUNTS
You may create an account on the Website. You are responsible for providing accurate and current information, maintaining the confidentiality of your login credentials, and all activity conducted through your account.
You must notify us promptly at support@nestchill.com if you believe your account has been accessed without authorization. We may suspend or terminate accounts that violate these Terms or create a security, fraud, or legal risk.
4. PRODUCT INFORMATION
We make reasonable efforts to present our products accurately. However, colors, brightness, scale, and details may appear differently depending on the screen, lighting, photography, and device used. Measurements and product images are provided for reference unless expressly stated otherwise.
Hand-finished and custom-made products may have minor variations in engraving, polishing, texture, color, or finish that are inherent to the production process. Such minor variations do not by themselves constitute a defect, provided that the product materially conforms to the approved design and order specifications.
We may correct errors, update product information, change prices, limit quantities, or discontinue a product at any time. If a material error affects an order already placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.
5. CUSTOM ORDERS AND 3D MODEL APPROVAL
Nestchill creates personalized products using photographs, instructions, names, text, measurements, and other materials submitted by customers (“Customization Materials”).
You are responsible for reviewing all Customization Materials and order information before submission. After receiving the required materials, Nestchill may create a digital or 3D model for your review. You must carefully review the model, including the subject, pose, proportions, spelling, layout, and other visible details, before approving it.
Your approval authorizes Nestchill to begin physical production based on the approved model. Once you approve the model and physical production begins, the order cannot be canceled or refunded solely because you changed your mind, no longer want the product, or overlooked a detail that was visible in the approved model.
Digital or 3D models are visual production previews. The final physical product may show minor differences caused by material properties, scale, polishing, engraving, manufacturing tolerances, lighting, or screen display.
6. CUSTOM-ORDER CANCELLATIONS AND REFUNDS
Because custom orders require individualized design, 3D modeling, and production work, cancellation eligibility depends on the stage of the order:
Before 3D modeling work begins: If we receive and approve your cancellation request before any custom design or 3D modeling work has begun, you will receive a full refund.
After 3D modeling work has begun, but before physical production begins: You will receive a refund equal to 70% of the amount paid for the affected custom product. The remaining 30% is retained as a non-refundable custom design and 3D modeling fee for work already performed.
After model approval and the start of physical production: The order is final and is not eligible for cancellation or a change-of-mind refund.
To request cancellation, contact support@nestchill.com as soon as possible. A request is not effective until Nestchill confirms the order’s production stage and cancellation status in writing.
These custom-order limitations do not apply when the product is materially different from the approved design or order, is defective, arrives damaged, or where a refund or other remedy is required by applicable law. They also do not limit any remedy expressly provided under our Return and Refund Policy.
If Nestchill cancels an order, cannot fulfill it, or cannot ship it within the promised time and you do not agree to a revised shipping date, we will provide a full refund to the original payment method as required by applicable law. Store credit will not be substituted for a legally required refund unless you expressly agree.
7. PRICES, BILLING, AND PAYMENT
Prices are shown in the currency displayed at checkout and may change without notice. A price change will not affect an order already accepted, except where there is an obvious pricing or listing error.
You agree to provide complete and accurate billing, shipping, contact, and payment information. You authorize us and our payment service providers to charge the amount displayed at checkout, including any applicable taxes, shipping charges, and other disclosed fees.
Payments may be processed by third-party payment providers. Their handling of payment information is governed by their own terms and privacy practices. Nestchill does not guarantee the availability of any particular payment method.
We may reject, limit, hold, or cancel an order where information is incomplete, payment is not authorized, fraud is suspected, the order appears intended for unauthorized resale, or fulfillment is not reasonably possible. If we cancel an order after payment and no amount is properly retained for completed custom work under these Terms, we will issue the applicable refund to the original payment method.
8. SHIPPING AND DELIVERY
Shipping estimates are estimates unless expressly guaranteed. Delivery times may be affected by customization, customer approval time, destination, carrier operations, customs, weather, and other circumstances outside our reasonable control.
Applicable shipping terms, delivery estimates, address-change rules, customs information, and procedures for delayed, lost, or damaged packages are described in our Shipping Policy. Nothing in these Terms limits any right you may have when an order is not shipped within the time required by applicable law.
9. RETURNS AND REMEDIES
Returns, replacements, repairs, and refunds are governed by our Return and Refund Policy together with the custom-order rules in these Terms. Personalized products are not eligible for change-of-mind returns after approval and the start of physical production, but this does not remove rights relating to defective, damaged, incorrect, or materially nonconforming products.
You should contact support@nestchill.com promptly after discovering a problem and provide the order number, a description of the issue, and reasonable supporting photographs where relevant.
10. CUSTOMER MATERIALS AND CONTENT
You retain ownership of photographs and other original content you submit to Nestchill. By submitting Customization Materials, you grant Nestchill a non-exclusive, worldwide, royalty-free license to access, copy, modify, adapt, and use those materials only as reasonably necessary to process your order, create designs and models, manufacture the product, provide customer support, prevent fraud, maintain legally required records, and resolve disputes.
You represent that you own the Customization Materials or otherwise have all permissions needed for Nestchill to use them for these purposes. You must not submit content that infringes intellectual property, privacy, publicity, or other rights; is unlawful, abusive, or deceptive; or contains malicious code.
Nestchill will not use customer photographs or Customization Materials in advertising, social media, or public promotional materials without separate permission from the customer.
You may request deletion of your Customization Materials by emailing support@nestchill.com. We will process valid deletion requests subject to information that must be retained for ongoing order fulfillment, fraud prevention, dispute resolution, accounting, security, or legal compliance. Deleting source materials may make it impossible for us to complete an active order or provide certain future support or reproductions.
11. REVIEWS, COMMENTS, AND FEEDBACK
The Website may allow customers to submit ratings, reviews, photographs, comments, feedback, or other public content (“User Content”). You retain ownership of your User Content. By posting it publicly on the Website, you grant Nestchill a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that User Content in connection with operating and promoting the Website and Nestchill products.
You represent that you have the necessary rights to post your User Content and that it is accurate, lawful, and does not infringe the rights of another person. You may not post false, defamatory, threatening, obscene, discriminatory, deceptive, confidential, infringing, or malicious content.
We may moderate, reject, or remove User Content that violates these Terms, applicable law, or the rights and safety of others. We are not obligated to publish or retain any review or submission. Any incentive provided for a review must be disclosed as required by applicable law.
12. INTELLECTUAL PROPERTY AND OWNERSHIP
The Website and all content created or provided by Nestchill, including its name, branding, logos, product photographs, graphics, text, page designs, software, custom product designs, and 3D models, are owned by Nestchill and are protected by applicable intellectual property laws.
Except for the limited personal use necessary to browse the Website, place an order, or keep records relating to your purchase, you may not copy, reproduce, modify, publish, distribute, sell, license, commercially exploit, scrape, or create derivative works from Nestchill content without our prior written permission.
The ownership provisions in this section do not transfer ownership of a customer’s original photographs or other pre-existing Customer Materials to Nestchill.
13. OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Website may provide access to third-party services, integrations, payment providers, social networks, or tools. We do not control those third parties and are not responsible for their independent services, content, availability, security, or privacy practices.
Your use of third-party services is subject to the applicable third party’s terms. References or links to third parties do not imply endorsement.
14. PRIVACY
Our collection and use of personal information are governed by our Privacy Policy. By using the Website, you acknowledge that your information may be processed as described in that policy and by relevant service providers involved in payments, hosting, order processing, manufacturing, delivery, analytics, security, and customer support.
15. PROHIBITED USES
You may not use the Website or its content to:
violate any applicable law or the rights of another person;
infringe intellectual property, privacy, publicity, or proprietary rights;
submit false, fraudulent, misleading, abusive, or unlawful information;
transmit malware or other harmful code;
collect or track personal information without authorization;
spam, phish, scrape, crawl, or access the Website through unauthorized automated means;
interfere with the Website, its security features, accounts, networks, or connected services; or
impersonate another person or misrepresent your identity or affiliation.
We may suspend or terminate access for prohibited conduct.
16. ERRORS AND AVAILABILITY
The Website may occasionally contain typographical errors, inaccuracies, omissions, or temporary interruptions. We may correct or update information and, where necessary, cancel an affected order. If we cancel an order because of our error, we will provide the applicable refund.
We do not promise that the Website will always be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue features of the Website, but doing so does not remove obligations already owed for accepted orders.
17. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Website and its general informational content are provided on an “as is” and “as available” basis. We disclaim warranties regarding uninterrupted Website access, complete accuracy of general Website content, and compatibility with every device or browser.
This disclaimer does not exclude warranties, consumer guarantees, remedies, or other rights that cannot lawfully be excluded. Specific commitments expressly made in an accepted order, approved custom model, product description, or written Nestchill policy remain subject to their terms.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Nestchill will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Website or purchase of a product, including lost profits, lost revenue, lost data, or loss of business opportunity.
Where liability may lawfully be limited, Nestchill’s aggregate liability arising from a particular order will not exceed the amount paid for that order.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, death or personal injury caused by negligence where applicable, or mandatory consumer rights.
19. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold Nestchill harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Website, your material breach of these Terms, or Customization Materials or User Content that you submitted in violation of another person’s rights.
This section does not require a consumer to indemnify Nestchill for Nestchill’s own negligence, misconduct, breach, or violation of law.
20. EVENTS BEYOND REASONABLE CONTROL
Nestchill is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, epidemics, war, civil unrest, labor disruptions, transportation interruption, carrier failure, governmental action, power failure, telecommunications failure, or supply-chain disruption.
We will take reasonable steps to minimize the effects of such events. This section does not remove any cancellation or refund rights that apply when an order cannot be shipped within the required or agreed time.
21. TERMINATION
You may stop using the Website at any time. We may suspend or terminate your access if you materially violate these Terms, misuse the Website, engage in fraud or unlawful conduct, or create a security risk.
Termination does not affect rights, payment obligations, approved orders, ownership provisions, licenses, limitations, or liabilities that arose before termination or that by their nature should survive.
22. SEVERABILITY AND WAIVER
If any provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted or severed to the minimum extent necessary. The remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of that provision or any other right.
23. ENTIRE AGREEMENT
These Terms, together with the policies and order-specific terms referenced on the Website, constitute the entire agreement between you and Nestchill concerning use of the Website and purchases made through it, and supersede prior agreements concerning the same subject.
If an order-specific term expressly conflicts with these Terms, the order-specific term controls only for that order and only to the extent of the conflict. Mandatory rights under applicable law always remain in effect.
24. CHANGES TO THESE TERMS
We may update these Terms by posting a revised version on the Website and changing the “Last updated” date. Changes apply prospectively from the effective date of the revised Terms unless applicable law requires otherwise.
Your continued use of the Website after revised Terms take effect constitutes acceptance of the revised Terms. Changes will not retroactively reduce rights attached to an order already accepted without your agreement.
25. GOVERNING LAW
These Terms and any separate agreement through which Nestchill provides products or services are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
This governing-law provision does not deprive a consumer in the United States of any mandatory protections that apply under federal, state, or local law and cannot lawfully be waived by contract.
